Terms of Service

These Terms of Service ("Terms") govern your access to and use of the identity-js website, application, API, and related services (collectively, the "Service") operated by Kontex, registered sole proprietor ("preduzetnik") based in the Republic of Serbia ("we", "us", "our", or "identity-js").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
identity-js is a web analytics platform that provides visitor identification through browser fingerprinting, behavioral tracking, and related analytics features. The Service consists of:
- A JavaScript tracker library installed on your website(s)
- A cloud-hosted API that receives and processes analytics data
- A web-based dashboard for viewing analytics and managing your account
2. Account Registration
To use the Service, you must create an account with a valid email address and a password of at least 8 characters. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account and use the Service.
3. Subscription Plans and Billing
3.1 Plans
The Service is offered under the following plans:
- Free — 1 project, 1,000 visitors, 10,000 events/month, 7-day data retention
- Pro ($19/month or $182/year) — 5 projects, 50,000 visitors, 500,000 events/month, 90-day data retention
- Business ($69/month or $662/year) — 20 projects, 500,000 visitors, 5,000,000 events/month, 1-year data retention
- Enterprise (custom pricing) — unlimited usage, custom terms
3.2 Payment Processing
All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. Paddle handles billing, invoicing, sales tax, and VAT on our behalf. By making a purchase, you also agree to Paddle's Terms of Service and Privacy Policy.
3.3 Billing Cycle
Paid subscriptions are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
3.4 Price Changes
We reserve the right to modify pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle, and we will provide at least 30 days' notice via email before any price increase.
4. Usage Limits and Fair Use
Each plan has defined usage limits for projects, visitors, and events. When you reach a limit:
- Visitor limit: New visitors will not be tracked, but existing returning visitors will continue to be tracked normally.
- Event limit: New behavioral events will stop being recorded until the next billing cycle.
- Project limit: You will not be able to create additional projects until you upgrade.
We reserve the right to suspend or throttle accounts that engage in abusive usage patterns, including but not limited to: sending artificially inflated traffic, using the Service for DDoS amplification, or attempting to circumvent usage limits through multiple free accounts.
5. Data Retention
Analytics data (events, sessions, behavioral data) is retained according to your plan's retention period. Data older than your plan's retention limit is automatically and permanently deleted. Visitor fingerprint records may be retained for the duration of your account to support returning visitor identification.
Upon account deletion, all associated data (projects, visitors, events, sessions) is permanently deleted within 30 days.
6. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service to track individuals without a lawful basis to do so
- Use the Service in a manner that violates any applicable local, national, or international law or regulation, including data protection laws (GDPR, CCPA, etc.)
- Attempt to reverse-engineer fingerprint hashes to identify specific individuals
- Use the Service to collect, store, or transmit personally identifiable information (PII) through custom events or any other mechanism
- Use the Service for any purpose that is harmful, fraudulent, deceptive, or discriminatory
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service or its related systems
- Resell or redistribute the Service without authorization (unless on an Enterprise plan with white-label rights)
7. Your Responsibilities
As the operator of website(s) that use identity-js, you are responsible for:
- Ensuring your use of the Service complies with all applicable data protection and privacy laws in the jurisdictions where your website visitors are located
- Providing any required disclosures to your website visitors about the use of analytics tools, as required by applicable law
- Maintaining the security of your API keys and account credentials
- Ensuring that custom events you send do not contain personally identifiable information
8. Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by us and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.
The identity-js JavaScript tracker library is distributed under the MIT License. This license applies only to the tracker library itself, not to the hosted Service, API, dashboard, or any other component.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY ANALYTICS DATA PROVIDED THROUGH THE SERVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IDENTITY-JS, ITS OWNER, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless identity-js and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights.
12. Termination
You may cancel your subscription and terminate your account at any time through the dashboard or by contacting us. Upon cancellation, you retain access to paid features until the end of your current billing period.
We may suspend or terminate your account immediately if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if required by law. In case of termination for cause, no refund will be issued for the remaining billing period.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be submitted to the exclusive jurisdiction of the courts of the Republic of Serbia.
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
15. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
